Rent a Car Terms and Conditions

General:

-         BOLD CAR RENTAL LLC  maintains the https://boldcarrental.com/Website ("Site").

-         “United Arab Emirates is our country of domicile” and stipulate that the governing law is the local law.

-         Any purchase, dispute, or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE”

-         Visa or MasterCard debit and credit cards in AED will be accepted for payment’’

-         The displayed price and currency at the checkout page, will be the same price and currency printed on the Transaction Receipt and the amount charged to the card will be shown in your card currency”.

-         We will not trade with or provide any services to OFAC and sanctioned countries.

-         Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website’’

-         Cardholders must retain a copy of transaction records and https://boldcarrental.com/ policies and rules.

-         The user is responsible for maintaining the confidentiality of his account.

Owner’s Undertaking

-         The Owner is responsible for the routine maintenance, servicing, and repair of the vehicle, (excluding damages and punctures) resulting from regular wear and tear.

-         To maintain comprehensive insurance coverage for the vehicle, including third-party liabilities for death and bodily injuries. The Owner holds the discretion to accept or decline Personal Accident Insurance (PAI) and Collision Damage Waiver/Super Collision Damage Waiver (CDW/SCDW) at an additional cost. It is crucial to acknowledge that the insurance policy excludes coverage for acts of sabotage, terrorism, flood, storm, hurricane, volcanic activity, volcanic eruptions, earthquakes, and other convulsions of nature. It also does not cover invasion by foreign enemies, hostilities, warlike operations (whether declared or not), civil war, strike, riot, civil commotion, mutiny, rebellion, revolution, insurrection, military or usurped power, confiscation, or nationalization. Additionally, damages resulting from reckless and drunken driving (under the influence of alcohol or any other substance) are not covered.

-         To facilitate the basic registration of the vehicle. Furthermore, it is the Hirer's responsibility to promptly notify the Owner for the arrangement of necessary permit(s) allowing the vehicle(s) to operate in any emirates. All associated costs for such permit(s) shall be borne by the Hirer.

-         The owner shall ensure the availability of a replacement vehicle during the maintenance and servicing of the hired vehicle. Replacement is subject to availability and shall not exceed a small saloon unless explicitly specified in the rental agreement. In the event of an accident, a replacement vehicle will only be provided upon the submission of the original Police report and repair slip, deemed acceptable by the insurance company, to the Owner.

Hirer Undertaking

-         The Hirer shall ensure the punctual remittance of the agreed rental charges, encompassing additional charges and taxes imposed by the United Arab Emirates, inclusive of adherence to prevailing and future Value Added Tax (VAT) laws related to this agreement. Payments are to be made in advance, without prior demand, and within the approved credit period. Any bank charges incurred in this process shall be borne by the Hirer.

-         The Hirer is obligated to bear the expenses associated with exceeding the agreed or allowable mileage for both passenger cars and commercial vehicles on a monthly, weekly, or daily rental basis. Any surplus kilometers shall be invoiced at the rate outlined in the agreement upon the end of the contractual period.

-         The Hirer shall be responsible for the payment of delivery or collection charges to and from locations other than the Owner’s branch, at the prevailing rate or cost. An additional charge of AED 100 shall be levied for deliveries or collections transacted on Sundays or other public holidays.

-         The Hirer acknowledges the responsibility to settle all fines, road tolls, road taxes, VAT, and expenses arising from breaches of traffic, municipality, and local laws. The Owner reserves the right to levy these fees on the Hirer’s account, or credit card, or transfer them to the Hirer’s driver’s license without prior approval and a specified temporal time limit.

-         The Hirer is subject to a refundable deposit of AED 2,000 to AED 10,000 depending on the car being rented. The deposit shall be reimbursed after 30 days for Dubai Emirate contracts and 40 days for all other Emirates contracts, commencing from the date of vehicle return. The Hirer is liable for THE KNOWLEDGE Dirham, traffic fines, toll charges, and any surcharges imposed by authorities, settled by the Owner on behalf of the Hirer. A surcharge, as specified in this agreement, shall be imposed on each traffic fine offense and toll charge, inclusive of VAT for service charges. The entire sum, encompassing the fine amount and toll charges, is due within 3 months from the date of intimation. The Hirer also undertakes to pay AED 50 per traffic fine per day if not reimbursed to the Owner within 3 days.

-         The Hirer is obligated to bear any additional costs incurred by the Owner to comply with authorities (Police/RTA, etc.) for enforced modifications or additional fitments to the vehicle.

-         The Hirer is required to bring the vehicle for routine service/repair within the service due kilometers and renewal of registration at least 7 days before its expiry. All fuel costs and Salik Toll charges incurred in transporting the vehicle for service/repair/registration, including the replacement vehicle, shall be the responsibility of the Hirer.

-         In the case of Monthly Rental, the Hirer shall make an advance payment of AED 150 plus VAT per month for an additional driver (other than the Hirer). For daily and weekly rentals, an advance payment of AED 75 plus VAT is required. The additional driver must be registered in the Rental Agreement. The Hirer accepts responsibility for all accident repair charges if the driver is not registered in the rental Agreement.

-         The Hirer shall ensure that all drivers possess a valid UAE driving license exceeding 6 months. For licenses less than 6 months old, the driver must additionally possess a license from their country of origin exceeding 1 year. In the case of a visit/tourist/transit visa, the driver must possess an International Driving license along with a local driving license from the country of origin (more than 1 year old). Noncompliance will incur additional liability of 10% of the total damage cost for accidents due to the driver's fault, including hit-and-run cases.

-         The Hirer is required to immediately inform the Owner in the event of an accident, and obtain a police report and repair slip acceptable to the insurance company. The Hirer shall bear AED 1000 (Passenger Vehicle) and AED 1500 for 4WDs and Commercial Vehicles out of the total indemnity, unless CDW/SCDWs are accepted in advance and paid, thereby reducing the insurance excess to AED 500, AED 750, or NIL. The Hirer shall be responsible for all costs of repair to the vehicle, third-party damage, and loss of use if it is not possible to obtain a police report to make an insurance claim.

-         The Hirer shall maintain all fluid levels and tire pressures at the specified required levels and accept financial liability for any damage resulting from the use of the vehicle below these levels.

-         The Hirer is prohibited from subletting or giving possession of the vehicle to a third party or using it for illegal, criminal, or any purpose other than intended. Insurance coverage is not applicable for these activities.

-         The Hirer shall not use the vehicle for hire, rallying, racing, any type of off-road application, driving through pools of water, overloading, or exceeding the number of passengers for which the vehicle is licensed. Insurance coverage does not extend to damages or losses arising from these activities.

-         The Hirer shall not take the vehicles outside of UAE territories.

-         The Hirer is obligated to return the vehicle on the due date in the condition it was handed over, including a cleaned interior and exterior. In case of damages, the Hirer agrees to pay for the repair as per the Owner's estimate and the rental of the vehicle until it is repaired.

-         The Hirer shall pay for the usage of Owner's fuel at 1½ times the prevailing market price and cleaning costs of AED 50 for the exterior, AED 150 for the underbody, and AED 250 for the interior.

-         The Hirer shall ensure that no unauthorized person repairs or carries out modifications on the vehicle without the Owner's prior written approval. The Hirer will be responsible for any taxes, levies, penalties, fines, or charges resulting from these changes.

-         The Hirer shall compensate the Owner for all losses, including loss of profit, due to a failure to comply with any terms of this agreement.

-         The Hirer accepts all liabilities and holds the Owner harmless for the use of the vehicle on hire and under the possession of the Hirer.

Insurance

- In case of an accident, the Hirer assumes responsibility for the specified AED amount constituting the total indemnity and waives any claims against this amount. The Hirer acknowledges the obligation to prepay the Collision Damage Waiver (CDW) and agrees to furnish the Owner with the original Police Report slip for processing an insurance claim. (b) By affixing my signature below, I authorize the Owner to debit my credit card for rental fees, penalties, or any other charges under this Rental Agreement. (c) I express no objection to the Owner transferring traffic fines incurred for traffic offenses during the rental period to my driving license if left unpaid by me. (d) It is mutually agreed that this Rental Agreement shall automatically renew under the same terms and conditions until the vehicle is physically returned to the Owner. (e) I affirm the accuracy of all information provided, with no concealment of relevant details.  (f) I/We, having read and comprehended the terms and conditions on both sides of this Agreement, acknowledge acceptance, agreement, and commitment to abide by said terms and conditions. (g) I/We further confirm the accuracy of the information provided above to the best of my/our knowledge and assert that no details required herein have been concealed. (h) In the event, that a driver below 23 years of age operates the hired vehicle, and in the event of an accident attributed to the driver's fault with an unidentified third party, the Hirer shall be liable to pay 10% of the claim amount over and above the excess specified in the rental agreement. This provision applies even if the Hirer has opted for CDW.      

Termination & Vehicle Re-possession

-     The Hirer explicitly agrees that should the rented vehicle be returned before the completion of the initial month (for monthly hire) or before the conclusion of the initial week (for weekly hire), the Hirer will incur charges at the applicable daily or weekly rates. Furthermore, the Hirer acknowledges that pre-termination charges will be applied to promotional contracts, including but not limited to a minimum 3-month hire, minimum 6 months hire, and minimum 12 months hire.

-         The Owner retains the discretion to terminate the contract, or immobilize and repossess the vehicle under the following circumstances:

o    Misuse of the vehicle by the Hirer.

o    Involvement of the vehicle in illegal or criminal activities.

o    Frequent occurrence of accidents involving the vehicle.

o    Accumulation of frequent traffic fines.

o    Non-payment of rental charges or any other outstanding amount to the Owner beyond 7 days from the due date.

o    Breach of obligations specified in this contract by the Hirer.

o    Damage to, manipulation of, alteration, or attempted alteration of any of the Owner's properties, assets, vehicles, or devices installed inside the vehicles by the Hirer.

Authorization

I authorize BOLD to debit any of my Credit Card(s) from above for any charges relating to this agreement during or after the hire period. In the event of an accident, the Hirer assumes responsibility for the AED amount, opting for a waiver. Disputes will be adjudicated as per the agreed terms. By affixing my signature, I acknowledge and accept the conditions outlined herein until the termination of this contractual agreement

 Payment Confirmation

-       - Once the payment is made, the confirmation notice will be sent to the client via email within 48 hours of receipt.

-       - In case any delays in the receipt of payment, both parties shall be responsible in following with their respective banks to establish the whereabouts of the transaction.

 Refund Policy

-         Refunds will be done only through the Original Mode of Payment and will be processed within 10 to 45 days depending on the issuing bank of the credit card.

Cancellation Policy

-       - Customer can cancel their order/requested services within 48 hours; refunds will be returned to the payment solution used initially by the customer. Please allow for up to 45 days for the refund transfer to be completed.

-       - Any cancellation that happens within 48 hours, a one-day car rental amount shall be deducted from the booking fee. Delivery

 This agreement shall be governed by the laws of the United Arab Emirates (UAE).
